Report on Consultation on Prescribed Information in Registrable Leases

Dron & Wright fully supported the consultation process earlier this year in relation to the prescribed information in registrable leases. Our principle concerns were to ensure that the amount of required information was kept to a minimum for which the comment in the report was:

‘Typical of these responses was that of Peter Wonnacott of Dron & Wright: "we believe the form should have the minimum of information (to allow registration) and should be in the simplest form possible", a view that was endorsed by the Law Society of England and Wales’

And that in the event of a conflict between the prescribed information and the lease itself, that the lease must take precedent (the opposite of the Land Registry’s intention). The report’s comment was:

‘The Law Society, Peter Wonnacott of Dron & Wright and Jo L. Taylor of the Land Law Team, Property Rights and Law Commission Branch of the Department of Constitutional Affairs and Clifford Chance all made similar observations. These comments have been reflected in the final version of the prescribed information'.
